End-user licence agreement

This licence agreement applies between you and Gwen Huyge (“I” below), who created Anatomino. It sets out how you may use the app: the free version and the Basic and Pro licences. It also contains the refund policy.

By installing or using Anatomino, you agree to this agreement. So please read it first; if you do not agree, do not use the app.

Who grants the licence and who sells

The licence is granted to you by me:

  • Gwen Huyge, self-employed on a part-time basis

The purchase itself is made from Paddle (Paddle.com), which acts as reseller and merchant of record. Paddle sells you the licence, collects the payment, issues the invoice, pays the VAT and carries out refunds. Paddle’s terms therefore also apply to the purchase. What you may do with the app is set out in this agreement.

What Anatomino is

Anatomino is a study aid for Windows and macOS for learning to recognise and name structures of the human body by their Latin names, on 3D models. The app contains five systems: the skeleton, the muscles, the nervous system, the blood vessels and the organs. The interface, the hints and the descriptions are in Dutch; the names you learn are Latin.

Everything runs on your own computer. What the app stores and when it connects is described in the privacy statement.

The free version

  • The free version includes every exercise for the head, in every system, with their parts, and your history and weak points for them. You can explore every system, without the parts of structures outside the head. It works without limits and with no end date.
  • The free version is free and does not oblige you to anything. Your profile and your history are always kept, also if you buy a licence later.
  • I may change which content is free with an update. What you bought with a licence remains yours.
  • Circumventing the limits of the free version, for example by editing the app’s files, is not allowed.

Your licence

After your purchase you receive a licence code. With it, I grant you a personal, non-exclusive and non-transferable right to use Anatomino with the content of your licence, with no end date:

  • Basic: every system, region and type of exercise, with the parts of the structures of the head.
  • Pro: everything in Basic and all parts of structures.

Your licence applies to one major version of the app (see Updates and new major versions). In addition:

  • Tied to one email address. The licence belongs to the email address of your order and only works in a profile with that email address. Once a licence is attached to a profile, the email address of that profile is fixed.
  • Personal, on 2 devices. The licence is for you alone. You may use it at the same time on at most 2 devices that you use yourself, for example a laptop and the computer at home. You may not share, resell, rent out, lend or transfer the licence or the code.
  • Activation. You activate the licence online once on each device. If you want to use it on another device while it is already active on 2 devices, first release a device in the app. You can do that at most 3 times every 30 days; if that does not work for you, email me.
  • Online confirmation. Practising works without the internet. With a licence, however, the app needs to connect briefly at least every 90 days to check that the licence has not been revoked and that the device is still active. This happens automatically whenever you start the app with an internet connection; in the last 14 days the app warns you. If it fails for longer, the app works as the free version, and the licence works again as soon as the confirmation succeeds.
  • Lost your code? Email me from the email address of your order and I will send the code to that address again.

What you may and may not do

You may:

  • install and use Anatomino on the computers you use yourself, for your studies and your own knowledge;
  • use the 3D models under their own open licence (see Third-party content).

You may not:

  • share, publish or sell your licence code, or use a code that was not meant for you;
  • circumvent, disable or imitate the licence check, the activation, the online confirmation or the limits of the free version, or create or forge codes or activations;
  • modify or decompile the app or make derivative works of it, except to the extent that mandatory law allows it or the open licence of a component permits it;
  • rent out or lend the app or your licence, or offer it as a service to others;
  • use the app for anything the law prohibits.

Updates and new major versions

Your licence applies to one major version of Anatomino: the first number of the version number, currently 4. Every update and improvement within that major version (4.0 up to 4.x.x) is free for licence holders. The app tells you about a new version; you decide whether and when to install it. In the Microsoft Store version, Windows handles the updates. On a Mac that cannot update itself, the app opens the download page and you install the new version yourself.

A new major version (5.0) brings completely new features and is not covered by your licence. Existing licence holders can buy the upgrade for €9.99. If you install a new major version without the upgrade, it works for you as the free version; you can always reinstall the latest version of your own major version. Moving from Basic to Pro costs €10.

I keep providing the bug fixes and security updates needed to keep your major version working as described, free of charge, for as long as the law requires. I do not promise new features, systems or structures. This agreement also applies to every update.

Revocation in case of abuse

I may revoke a licence:

  • if the payment is reversed, after a refund or a dispute with your bank;
  • if the licence or the code is shared, sold or published;
  • in case of other serious abuse of this agreement, such as circumventing the licence check.

Except after a refund, I will first tell you why, at the email address of your order, so that you can respond.

What happens then. The number of the licence is added to the public, signed list of revoked licences; your name and email address are not on it. At the next connection, and at the latest after 90 days, the app returns to the free version for that profile. Your profile, history and settings remain on your computer: I do not delete anything on your computer and cannot do so. On my side, the order data and the reason for the revocation are kept for as long as the privacy statement says, so that I can explain the revocation and, if it was unjustified, undo it.

Third-party content

The 3D models in Anatomino come from open sources whose licence allows use in a paid app. They have been converted, aligned and rescaled for the app, and in that form remain under their original licence:

  • Human Reference Atlas (Kristen Browne, Heidi Schlehlein et al., HuBMAP), under CC BY 4.0: the female reproductive organs, the placenta and the female pelvis.

Nothing in this agreement limits the rights you have under those licences. You may therefore use, adapt and share those models under those licences: with attribution and, for CC BY-SA, under the same licence. The full attribution is also in the app, under Instellingen › Over de inhoud (Settings › About the content).

The app is built with open-source software, including Electron (with Chromium and Node.js) and Three.js. Those components are covered by their own open-source licences, which take precedence over this agreement for those components. Their licence texts are included in the app’s installation.

The rest of Anatomino, such as the code, the texts, the Dutch names, the hints, the choice and position of the parts of structures and the design, is my work.

Not a medical device

Anatomino is a study aid. It is not a medical device and does not give medical advice: do not use it to make a diagnosis, choose a treatment or make other medical decisions.

The models are based on one body, with some female structures from a second, while anatomy varies from person to person. The names, hints and descriptions were put together with care, but may contain errors and do not replace your course, your atlas or your teacher. If you spot an error, please let me know.

Warranty and liability

As a consumer you have legal rights, including the legal guarantee that digital content works as described. Nothing in this agreement limits those rights. If Anatomino does not work as described, contact me: I will try to fix the problem, and if that does not succeed within a reasonable time, you are entitled to a price reduction or a refund, as the law provides.

Try the app for free before you buy: that way you can see whether it works well on your computer. I cannot guarantee that the app works without errors or interruptions on every computer.

To the extent permitted by law, I am not liable for indirect damage, such as lost study time, an exam result or lost data, and my liability is limited to the amount you paid for your licence. These limitations do not apply in case of intent or gross negligence, nor to damage that the law does not allow to be limited.

Back up your data regularly; the app helps you do this under Instellingen › Updates en back-ups (Settings › Updates and back-ups).

Refund policy

If you are not satisfied, you get your money back if you ask within 14 days of your purchase, without having to give a reason. [assumption, to be confirmed]

  • How: through the link in Paddle’s confirmation email, or by emailing me at [to be completed: email address] with your order number.
  • What you get back: the full amount, including VAT. Paddle refunds it through the payment method you used.
  • Afterwards: I revoke the licence (see Revocation in case of abuse). Your profile and history are kept; the app continues to work as the free version. For an upgrade (to Pro or to a new major version), I only revoke the code of the upgrade; your previous licence keeps working.

This policy comes on top of your legal rights. As a consumer in the European Union, you in principle have a 14-day right of withdrawal when you buy digital content. That right ends when delivery begins with your express consent and you acknowledge that you lose it as a result. Even then, you can ask for your money back within 14 days of your purchase under this policy.

Applicable law and disputes

This agreement is governed by Belgian law. If you are a consumer with your habitual residence in another country, you keep the protection of the mandatory rules of that country’s law.

If you have a complaint, please email me first: we can usually find a solution together. If not, you can turn to the Belgian Consumer Mediation Service (consumerombudsman.be) or to the competent court. If you live in the European Union, as a consumer you can also go to the court where you live.

Changes and language

I may change this agreement, for example when the app or the law changes. The new version is published on this page with its date. A change does not apply retroactively and does not take away rights you obtained with your purchase without your consent.

This agreement exists in Dutch, French, English and German. The Dutch version prevails.
